TERMS AND CONDITIONS

Please read this section carefully.  Travel One, Inc. makes travel reservations and performs travel-related services according to these Booking Conditions.  By using Travel One’s website, online booking tool(s), or by making travel arrangements through Travel One, Inc., you hereby agree to all of the Terms and Conditions listed here.

USE OF THIRD PARTY SUPPLIERS-DISCLAIMER

In making reservations and other travel arrangements on behalf of its customers, Travel One, Inc. acts as an agent of various third party suppliers, who are independent of Travel One, Inc.  Such third party suppliers are exclusively responsible for providing services contracted for air, cruise, ground transportation, hotel or resort accommodation(s), sightseeing, excursions and other privileges and services that may not be specifically mentioned here.  You accept that Travel One, Inc. and its agents, employees, representatives, successors or assigns maintain no control over the operation, equipment or personnel of such suppliers and therefore assume no liability or responsibility for any personal injury, property damage or other loss, accident, delay, defect, irregularity or inconvenience, caused by any wrongful or negligent act or omission on the part of any service provider.  You agree to look solely to the actual suppliers of the services for any remedy in the event of any loss, damage, injury or claim.

GENERAL LIMITATION OF LIABILITY

IN NO EVENT SHALL TRAVEL ONE, INC., INCLUDING ITS OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES, AFFILIATES, OR PROVIDERS (COLLECTIVELY, THE “COVERED PARTIES”), BE LIABLE FOR ANY INJURY, DEATH, LOSS, CLAIM, DAMAGE, ACT OF GOD, ACCIDENT, DELAY, OR ANY SPECIAL, EXEMPLARY, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY KIND, WHETHER BASED IN CONTRACT, TORT OR OTHERWISE, WHICH ARISE OUT OF OR ARE IN ANY WAY CONNECTED WITH ANY USE OF THIS SITE OR WITH ANY DELAY OR INABILITY TO USE THIS SITE, OR FOR ANY INFORMATION, SOFTWARE, PRODUCTS OR SERVICES OBTAINED THROUGH THIS SITE, EVEN IF TRAVEL ONE, INC. HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN ADDITION TO THE WAIVER OF CERTAIN CLAIMS AS PROVIDED HEREIN, CUSTOMER AGREES THAT IN NO EVENT SHALL TRAVEL ONE, INC. BE LIABLE TO CUSTOMER FOR LOST BUSINESS, LOST PROFITS, OR ANY OTHER CONSEQUENTIAL, INCIDENTAL, SPECIAL, PUNITIVE OR EXEMPLARY DAMAGE.

 

TRAVEL ADVISORIES

It is the responsibility of each passenger to be aware of the US State Department travel advisory for the countries visited.  Travel One does not make any representation or warranty regarding safe conditions or environments of the destination(s) booked through or by Travel One and that the individual(s) traveling through this booking each have an independent obligation to determine whether any unsafe condition may exist that may adversely affect the trip. For information on various travel advisories and risks, travelers can check the U.S. State Department’s website at www.travel.state.gov.

Travel One has no special knowledge regarding any health hazard(s), such as diseases or illnesses, that the individual(s) traveling through this booking may experience or encounter through their visit to their intended destination(s) as a result of their travels, and, consequently, Travel One does not make any representation or warranty regarding the health or wellness that such individuals may experience as result of their travels. The individual(s) traveling through this booking also assume full and complete responsibility for checking and verifying all required vaccinations for the intended destination(s) and all conditions regarding health and wellness issues that may be present or prevalent at the intended destination(s). For medical or health information related to the intended travel or destination(s), Travel One recommends contacting the Centers for Disease Control at (877) FYI-TRIP or www.cdc.gov/travel.

INTERNATIONAL TRAVEL

A VALID PASSPORT BOOK IS REQUIRED FOR TRAVEL FOR ALL PASSENGERS. Some countries require that your passport be valid at least six months beyond the dates of your trip and/or may require that your passport have two to four blank visa/stamp pages.

If your passport book is expiring within 12 months of travel it is your responsibility to discuss the requirement(s) of your destination with your travel specialist.

Travel One is not responsible for denied boarding due or lost payments due to passport expiration or visa related issues. Additional information is available at www.travel.state.gov.

A VISA may be required for your destination of travel. Check each destination.

Should a visa not be issued for any reason, Travel One is not responsible for lost payments made toward the contemplated trip.

DOMESTIC TRAVEL

Passengers over 17 are required to present a valid state- or federally-issued ID that displays a photo, name, date of birth, expiration date and gender. Each ID also must possess a tamper-resistant feature like a hologram or state seal. A full list of acceptable documents is available on the TSA’s website www.tsa.gov/travel/security-screening/identification.

Attorneys Fees

In the event of an action to enforce this Agreement or to seek remedies for breach of this agreement, including the failure to make timely payment, the prevailing party shall be entitled to recover from the other party its costs, disbursements and reasonable attorney’s fees.

Governing Law/Jurisdiction

This Agreement and any disputes arising in connection herewith shall be governed by the internal laws of the State of Minnesota, without regard to its conflicts of laws principles.  All actions relating to this Agreement shall be brought and tried in the Hennepin County District Court, 4th Judicial District, State of Minnesota.  The parties hereby consent to submit to the personal jurisdiction of such court and to venue therein.

Changes

Travel One, Inc. reserves the right to revise any of these terms at any time without notice.
